If you do not agree with these terms, please refrain from using our website to review information or obtain goods, services, or products.

We strive to maintain a high level of professionalism, efficiency, and courtesy in our interactions with both Customers and Service Providers. In these our Standard terms and conditions “weâ€, “our†and “us†means Bestadventures.mu, “youâ€, “heâ€, “sheâ€, “customerâ€, “participantâ€, “clientâ€, “passengerâ€, “Groupâ€, “memberâ€, “paxâ€, means the person making the reservation includes also all bookings made for 2 or more people and includes all the people travelling with you and for the avoidance of doubt any individual you make a booking on behalf of. As for “Supplier†or “Service Provider†means the entities or businesses that offer products, services, or experiences listed on Best Adventures Mauritius platform. These service providers could include hotels, tour operators, activity providers, and other businesses that collaborate with Best Adventures Mauritius to offer deals to customers.

When making a booking we assume that you are the lead contact for your group, and as such, all communication and discussions regarding arrangements for yourself and all members of your group will be conducted between you and us. These standard terms and conditions shall form the basis of the agreement for you and your group’s holiday or excursions and shall apply to the exclusion of any other terms and conditions whether put forward by you, your group or a third party or whether implied by law or statute. No alteration to these conditions shall be effective unless expressly agreed to in writing by a director of Bestadventures.mu

Our Platform.
We strive to provide accurate information on our Platform, but we rely on data from Service Providers, therefore we are not responsible for any errors or omissions that may occur. We aim to promptly address or correct any issues that arise.

The Service Provider bears sole responsibility for the service/product, delivery, quality and care of the service provided. In no case, we are not directly involved in the agreements between you and the Service Provider. Please note that our Platform does not endorse or recommend any specific Service Provider or their offerings. We display offers tailored to your country and provide content in what we believe is your preferred language. You have the option to switch languages at any time.

To book an Experience, you must create an Account and ensure that all your information, including payment and contact details, is accurate and current. Safeguard your Account credentials to prevent unauthorized access.

Forbidden Actions.
You are strictly prohibited from using the Platform for any purpose other than its intended use as specified by us. Commercial activities not explicitly sanctioned by us in writing are prohibited on the Platform.

If you are found to be engaged in fraudulent activities, abuse, non-compliance with laws or regulations, or any inappropriate or unlawful behavior (such as violence, threats, or invasion of privacy), we reserve the right to pursue legal action against you.

In such cases, we reserve the right to suspend your ability to make purchases, cancel any existing orders, and/or terminate your access to the Platform, our customer services, and/or your account.

Copyright.
The content, layout, graphics, design, compilation, digital conversion, and other components of the Site are safeguarded by relevant copyrights, trademarks, registered trademarks, and proprietary rights. Your copying, redistribution, usage, or publication of any such elements or any portion of the Site is strictly prohibited. You do not acquire ownership rights to any content, document, or materials accessed through the Site. Posting information or materials on the Site does not relinquish any rights to these materials. None of the content on this site should be copied or utilized for commercial endeavors without the explicit written consent of the owner.

Acceptance to the Sales Terms and Conditions.
Each customer is provided with the following sales terms every time they place an order. By proceeding with the order, the customer agrees to abide by the Terms and Conditions of Sale.
Clients who book through telephone, online chat, office visits, website, or email are considered to have read and agreed to the Booking Terms and Conditions outlined on the Bestadventures.mu website. Similarly, clients who make bookings through third parties, including agents, hotel representatives, family members, or those with gift vouchers, are also considered to have read and accepted these Booking Terms and Conditions.

In bookings involving multiple participants, the ‘Client’ is considered to have agreed to the terms and conditions on behalf of all participants within their party, group, or family. The ‘Client’ is the individual who makes the booking for all participants in a multi-participant booking and is identified in the ‘Client’ field within the booking. Throughout these Booking Conditions, the terms “you†and “your†refer to all individuals named on the booking, including those added later.

Reservations.
For us to ensure your reservation and arrange your preferred activity on your desired date, we recommend placing your order at least 25 days before your travel / excursion date. Please note that all reservations are subject to availability. If you have any special needs or disabilities that require attention, please inform us at the time of booking. We will make every effort to accommodate the needs of disabled tour participants. By booking with Bestadventures.mu, whether directly through our website or via email, you and all members of your group acknowledge acceptance of our standard terms and conditions. For group bookings (2 persons & more), the individual making the booking is responsible for informing all members of their group about these conditions.

Please take note that Bestadventures.mu does not display live availability for the several products featured on the website. All bookings will be confirmed by our customer service staff once a booking is made and as per the actual availability. It is recommended that you contact Bestadventures.mu before any online booking to confirm the availability for your desired dates and times. In the event a client books an activity without confirming the availability with one of Best Adventures’ agents, and there is no availability for the requested date & time, a cancellation fee (5% of total amount) will be charged for bank processing fees & handling costs. In addition to, if availability is communicated as per a client request but the client delay in making payment for confirmation of reservation (Especially in peak season example for catamaran, speedboat or accommodation or others), Bestadventures.mu will not be responsible hence the client should select another date as per availability. Note that in period from September to February, are considered as high season and some services are based on first come first served basis and require instant payment for confirmation reservation.

Please Note: Once a booking is paid, there is no cancellation and no refund. In case a customer choose to cancel a booking for any reason, full rate will be charged.

Prices.
Please note that prices for each specific Activity, Tour, and Excursion can be found in the product description on Bestadventures.mu. These prices include the cost of providing the attractions, handling fees, reservation fees, credit card processing fees, clearance fees, and local taxes unless otherwise specified. However, transportation, food, beverages, guides, tips/gratuities, and any other services not detailed in the activity specification are not included in these prices. Please note that the prices for the activities on Best Adventures Mauritius website are in Mauritian Rupees.

As we act as an agent for our suppliers, both we and our suppliers reserve the right to change, amend, or correct prices shown on our site at any time, both before and after you have booked. Child rates are available for children based on the age definition specific to each product.

Products/Activities.
The product offers provided on our website are subject to availability and supplied to customers through our suppliers and third parties. While we strive to accurately represent the activities through photos, illustrations, and promotional material, we cannot guarantee that all images illustrate the exact attraction as offered by the service provider. These visuals are intended to provide customers with a better understanding of the attractions within the same category. Descriptions and illustrations provided on our website and literature are approximate representations and are provided in good faith.

While we aim for accuracy in the details presented on our website and in our offers, we do not make any commitments regarding the accuracy, reliability, completeness, or timeliness of the material. Customers should use their discretion when relying on information provided on our website and in our offers.

Service Delivery.
We cannot be held responsible or offer compensation for circumstances beyond our or our supplier’s control, such as changes to your arrangements after departure, incomplete fulfillment of agreed arrangements, disruption, or any loss, injury, accident, or damage to personal property. These circumstances include, but are not limited to, war, terrorist activity, civil unrest, natural disasters, technical issues, and adverse weather conditions. Best Adventures Mauritius retains the right to cancel tours, attractions, or activities due to hazardous weather or unforeseen operational issues. Additionally, we reserve the right to refuse admission at our sole discretion.

Payment system & Payment Modes.
For all our products or services, the Service Provider will request an advance payment for booking confirmation of clients. We facilitate your payment process, taking responsibility for managing your payment and ensuring the completion of your transaction with our Service Provider. Your payment in this scenario serves as the final settlement of the “due and payable” price.

Online payment towards the purchase for any product or service advertised or offered by bestadventures.mu or a third party through the website may be by credit card, debit card, bank transfer, internet banking (Collectively, “Electronic Paymentâ€), bank deposit, online mobile banking, for a secure online payment system for all online reservations, for booking.

Rest assured, MasterCard and other payment mode ensures a high level of protection for your credit card details, with information securely stored in their database and inaccessible to third parties or Bestadventures.mu.

Should you become aware of or suspect any fraudulent or unauthorized activity involving your Payment Method, please reach out to Best Adventures Mauritius and/or your payment provider immediately. They may assist in reimbursing any associated charges, potentially subject to a fee.

You affirm that the Electronic Payment method utilized (debit or credit card details) is accurate, that the credit or debit card used belongs to you, and that there are ample funds available to cover the expenses. Once payment is cleared, you will receive an automated invoice and an automated Booking confirmation email of your order to your Account. Please note that an order will be considered valid only upon approval by MasterCard; if the transaction is not approved, the order will be automatically cancelled, and the client will be notified via email.

Best Adventures Mauritius Company bank account will be communicated to clients who wish to make payment via bank transfer, bank deposit, internet banking or using any online mobile banking, and it is obligatory that client send us a proof of payment and full name instantly once the transaction is completed for verification and to send booking confirmation. Best Adventures Mauritius is not responsible if the procedures is not followed and confirmation is not made. Therefore the client will have to opt for another date or package or claim for a refund if no availability.

Under no circumstances will Best Adventures Mauritius be liable for any kind of commission that your bank might charge you.

You are solely responsible for ensuring that you can provide a booking confirmation (either virtual or physical) and a valid national identity card or passport on the day of activity.

When it comes to electronic payments, you are solely responsible for ensuring the validity of the payment method, checking the availability of funds, understanding any applicable currency exchange rates and being aware of any applicable bank or transaction charges, fees, and commissions.

In case of a refund for the electronic payment, we will deduct any applicable bank or transaction charges, fees, and/or commissions imposed by the relevant banks during the refund process. Consequently, the refunded amount will be lower than the original electronic payment made.

If a payment is not fully completed, there’s a chance that by the time it’s finalized, availability or prices of attractions may have changed. In such cases, if tickets or rooms are no longer available or the prices have increased, you will receive a refund.

If an initiated partial payment is not completed, the amount paid will not be refunded, and a reservation will not be secured.

Charge-back customers who pull chargebacks *will* be reported to all major credit bureaus as a delinquent collection account.

No-Shows.
Once a booking is a paid, No-shows will be charged total rate; no refunds, rescheduling, or re-booking allowed.

Absences.
For group bookings (2 persons & more), the individual making the booking is responsible for informing all members of their group about these conditions. The individual takes responsibility for the entire group. In case a participant refuse to come for any reason or cancelled, there is no refund or rescheduling. The individual who made the booking takes the responsibility to replace the absences, and full rate is charged and any dues should be settled in full.

Delay.
On the day of activity, for any sea or land attractions booked, a customer should reach 30 minutes prior to the time of start or boarding. Any delay or if a customer or the group or any participant in the group fails to reach on time, the service provider and Best Adventures Mauritius reserve the right to start the activity and full rate will be charged, there will be no refund and no rescheduling. In case there is any amount, the individual who made the booking takes the responsibility to settle any due amount. In addition to return times indicated are based on normal road and weather or sea conditions and may change if conditions become unfavorable. Best Adventures Mauritius is not responsible for any delayed or disruption in the delivery process of the services booked on the day of activity, hence no refund claim will be acceptable.

During the Activity.
No refunds are available once a tour, activity, attractions or service has commenced, or in respect of any package, meal or any other services already utilized.

Activity Change.
If a customer initially books Activity A and later decides to cancel and book Activity B (even if Activity A is available and maintained), the customer must submit a request via email or WhatsApp for approval. If the request is approved both by our service provider and Best Adventures Mauritius it may include additional charges (if any) and no refund will be issued for the price difference between the two activities (if any). Conversely, In case the request not approved by both service provider and Best Adventures Mauritius, the original booking activity remain unchanged, and if the customer makes a no show or cancel the booking activity there will be full rate charged and any amount due should be settled by the individual who made the booking.

Date or Time Change:
If a customer wishes to change their originally booked date or time from January 1st to February 1st, they must submit a request via email or WhatsApp. The change is subject to availability for the new date or time. If the requested date or time is available and approved by both our service provider and Best Adventures Mauritius, the amendment will be made to the new date and it may include additional charges (if any). However, if the price for the new date or time is higher than the original amount paid, the customer must adjust the amount due accordingly. If he customer refuse to make any additional adjusted amount, the original booking date or time remain unchanged and in case the customer make a no show on that date, there will be full rate charged and any amount due should be settled by the individual who made the booking. Conversely, if the price for the new date or time is lower than the original amount paid, no refund will be issued upon approval of the new date.

On the other hand, in case the request for new date or time of activity is not available or not approved by both service provider and Best Adventures Mauritius, the original booking date or time remain unchanged, and if the customer makes a no show on the original date or time, there will be full rate charged and any amount due should be settled by the individual who made the booking.

Weather Conditions.
In the events of adverse weather conditions or forecasts, only the Supplier and Best Adventures Mauritius reserves the right to cancel, reschedule, reroute scheduled tours, attractions, and activities due to hazardous weather conditions or unforeseen operational problems. On the day of activity rain or shine, if the service provider is operational and the customers decides not to go, the customer will be charged full rate for cancellation and any amount due should be settled by the individual who made the booking.

Unforeseen Circumstances.
Best Adventures Mauritius and the service provider is not responsible for any disruption in the service on the day of activity once the activity has started based on unforeseen situation beyond our control, hence no rescheduling, no rebooking, no refund to customers.

Alcohol Restrictions.
The service provider reserve the right, to stop additional alcohol consumption during the activity, to refuse a client from performing snorkeling and swimming or to terminate their activity for security purpose in case they are found, hence no re-booking and no refund.

Consumer’s Behavior.
As a customer of Best Adventures Mauritius, you are accountable for the actions of yourself and your group, and are expected to conduct yourselves respectfully towards the environment and others. Suppliers reserve the right to terminate your stay or activity if your behavior poses a threat of vandalism, violence, or is otherwise deemed inappropriate by them, hence no re-booking, no refund.

Minimum number of participants.
In some cases, if a minimum number of participants is not met the service provider reserves the right to reschedules the trip / activity to another date, hence no refund.

Postponed Activity.
Any approved postponed activity has a validity of 1 month from the date of activity. In case there is price rise for the same particular activity when confirming the new rescheduled date compared to the original rate booked, the client has to adjust to the new price and settle additional amount for confirmation (applicable for only price rise).

Promotional Offer.
Once a booking is paid, any promotional offer publicized afterwards, the client cannot claim for any discount in case booking was made before any promotion and there will be no amendments and no refund.

Outside office hours.
Any amendments or request on booking sent outside working hours will be considered null and void and full rate is charged. Any amendments require approval during office hours.

Health and Physical Condition.
While Best Adventures Mauritius can provide information on the minimum physical and health requirements for our tours and services, but we are not medical experts. Note that our agents do not offer medical advice. Clients should consult their physician to determine their fitness for participating in specific tours or activities, as this is their direct responsibility. Some tours or services may not be suitable for all clients due to limitations in mobility, physical or cognitive disability, weight, age, pregnancy, or other conditions.

We encourage all clients to seek their physician’s advice regarding necessary vaccinations, medical precautions, or other concerns related to their travel with Best Adventures Mauritius. Clients are responsible for assessing the risks and requirements of each tour or service based on their limitations, physical and mental fitness, and condition.

If a client is unable to participate or complete an activity, tour, or package due to physical limitations or a medical condition, Best Adventures Mauritius is not liable for any costs or damages incurred. Refunds for the cost of any unused part of the tour or service are not mandatory and will be granted at the discretion of Best Adventures Mauritius. Additionally, Best Adventures Mauritius reserves the right to consider such bookings as canceled and may impose reasonable cancellation fees, as determined solely by Best Adventures Mauritius.

Concerns.
We do not provide guarantees against pricing errors or any issues arising from programming, technological, or computer-related issues. To assist us in resolving your concern promptly, please provide the following information:

The given booking confirmation number, contact details, and the email address used during the booking process.

A brief summary of the issue, along with any specific requests for assistance and any supporting documents such as photos, receipts, or emails.

All queries and complaints are documented, with priority given to urgent matters.

Complaints and problems.
In the rare event that you encounter any issues or have reasons to complain about your trip, activity, or attraction, please notify the relevant supplier immediately so that they can take appropriate action to address the problem. Some issues may require more time to resolve. If you are still dissatisfied, you must inform us in writing within 24 hours of the activity, providing your booking reference and detailed complaint.

Please note that our assistance in resolving your complaint is provided on behalf of our suppliers as agents only. Failure to follow this complaints procedure may limit our ability to assist you. It’s important to understand that the merchant or supplier is solely responsible for the quality and care of the services provided. Best Adventures Mauritius acts solely as a booking company.

Damage to or theft of personal belongings.
Best Adventures Mauritius is not responsible for any damage to or theft of clients’ personal belongings during activities. Therefore, Best Adventures Mauritius is not obligated to compensate clients for any such damages. It is the responsibility of each client to exercise caution and vigilance by closely monitoring their personal belongings and refraining from bringing valuables to the activity. Best Adventures Mauritius will not accept liability for the loss or damage of personal property or valuables.

Liabilities.
Best Adventures Mauritius acts as a Mediator (booking agent) for various suppliers of services, activities, attractions, and other offerings. We bear no liability for any death, personal injury, loss, consequential loss, or damage suffered by you, your group, or your dependents. Neither Best Adventures Mauritius nor the suppliers accept responsibility for government restrictions, acts of war or terrorism, weather conditions, or any other force majeure beyond our or the suppliers’ control. The quality and delivery of attractions and activities are the sole responsibility of the service provider or third party. By using Best Adventures Mauritius, you agree to hold Best Adventures Mauritius and its employees harmless and indemnify us against any liability. While we may assist in resolving issues, we reserve the right to take action against any supplier or party breaching their obligations.

Customer’s behavior.
As a customer of Best Adventures Mauritius, you are accountable for the actions of yourself and your group, and are expected to conduct yourselves respectfully towards the environment and others. Suppliers reserve the right to terminate your stay or activity if your behavior poses a threat of vandalism, violence, or is otherwise deemed inappropriate by them. You must refrain from behavior that may cause distress, annoyance, or risk of danger or property damage. In such cases, insurance coverage will be invalidated, and you will not be entitled to refunds, compensation, or coverage for any expenses. Any damages or losses caused by you or your group will be your responsibility and you will be liable for full payment. For certain activities like water sports, ziplining, quad biking, etc., Best Adventures Mauritius or our suppliers may require customers to sign a waiver. If a customer refuses to sign, the supplier may exclude them from the activity without compensation or refund. Additionally, in certain services such boat trips with include swimming and snorkeling, the clients are not allowed to get drunk on board. In case clients are found drunk, the service provider reserves the right to stop alcohol consumption and to refuse the client to snorkel and swim for security purposes. The client is fully responsible for any incident caused on day of activity due to alcohol consumption.

Litigation.
Any claim or dispute will be handled with utmost attention, presuming that the individual submitting the claim is acting in good faith. Initially, the client will attempt to resolve the issue amicably with the company. If a resolution cannot be reached, the Mauritian legal system will have sole jurisdiction over any legal proceedings.

Applicable rights.
The prevailing Terms and Conditions are governed by the Mauritian legal system. Any legal disputes concerning the commercial relationship between Bestadventures.mu and the client fall under the exclusive jurisdiction of Mauritian courts.

Force Majeure.
If there are any discrepancies between the advertised or contractually agreed inclusions of a product or service and the actual offerings, such as changes in itinerary or circumstances beyond control, including but not limited to environmental factors, natural disasters, border closures, government regulations, terrorist incidents, power outages etc, the Service Provider will make every effort to provide equivalent alternatives or, if necessary, compensate for any omitted services through alternative means (though no guarantee)

Disclaimer.
